TUESDAY:  A Regular Meeting of the Somerset County Board of Commissioners was held at 10:45 a.m. in the Commissioners’ Board Room.

 

 

PRESENT:  Pamela A. Tokar-Ickes, John P. Vatavuk, and James C. Approve Minutes

 

Motion by John P. Vatavuk, seconded by James C. Marker to approve the minutes of the meeting of May 27, 2008, as well as the minutes of the bid opening held on June 6, 2008.

 

The vote was unanimous.  Motion carried.

 

 

 

Approve Payment of Bills

 

Motion by James C. Marker, seconded by John P. Vatavuk to approve the payment of bills in the amount of $727,040.48.

 

The vote was unanimous.  Motion carried.

 

 

 

Bid – Coal

 

Carolyn M. Zambanini, Chief Clerk stated that bid opening for the purchase of coal for the Court House was held on June 6, 2008.  One bid was received from RFL Energy, Inc. in the amount of $207.86 per ton; the price per ton last year was $99.30.  A discussion was held regarding whether to reject or table the bid for further review.

 

 

Motion by John P. Vatavuk, seconded by James C. Marker to reject the bid for coal received from RFI ENERGY, LP of 555 Philadelphia Street, Indiana, Pennsylvania  15701-3901 in the amount of $207.86 per ton and to re-advertise for bids.

 

The vote was unanimous.  Motion carried.

 

 

 

Travel Requests

 

Motion by James C. Marker, seconded by John P. Vatavuk to approve the following travel requests:

 

requests for Charles Crimone, Natalie Hunt, Charla Chiapelli, Kim Logan, Sandra Benko-Presnell, and Jessica Eller of Children and Youth Services to attend the Independent Living Statewide Meeting on July 9-10, 2008 in Lancaster, Pennsylvania; and for Darcel Fahy and Sara Buterbaugh of Children and Youth Services to attend the Cindy King Training-Basic Forensic Interviewing on July 1-2, 2008 in Moon Township, Pennsylvania;

 

request for Karen Stiteler and Kim Trimpey of the Area Agency on Aging to attend the 2008 Dom Care Conference on June 24-25, 2008 in Harrisburg, Pennsylvania;

 

request for Richard Wagner of the Domestic Relations Department to attend the 2008 PA DRAP Conference on September  21-25, 2008 in State College, Pennsylvania; and

 

request for Donna Schmitt, Treasurer, to attend a Convention on June 10-13, 2008 in Erie, Pennsylvania.

Somerset County Economic Development Council

 

Motion by James C. Marker, seconded by John P. Vatavuk to approve the Somerset County Industrial Development Authority’s resolutions in connection with transactions authorizing the Miller Farm to obtain a limited obligation note in the amount of $119,000 and the Kisinger Farm to obtain a limited obligation note in the amount of $200,000 for the purchase of farmland and equipment under the Pennsylvania Department of Agriculture’s Next Generation Farmer Loan Program.

 

The vote was unanimous.  Motion carried.

 

 

 

Area Agency on Aging

 

Motion by James C. Marker, seconded by John P. Vatavuk to approve the Agreement between the County of Somerset and UNITED CEREBRAL PALSY, INC. of 119 Jari Drive, Johnstown, PA  15904, to provide attendant care programs in an amount not to exceed $334,017.00 per contract year, and to provide in-home services in an amount not to exceed $14,500.00 per contract year.

 

The vote was unanimous.  Motion carried.

 

 

Motion by James C. Marker, seconded by John P. Vatavuk to approve the Agreement between the County of Somerset and ALLEGHENY LUTHERAN SOCIAL MINISTRIES of 919 Hickory Street, Hollidaysburg, PA 16648, to provide in-home services in an amount not to exceed $288,700.00 per contract year.

 

The vote was unanimous.  Motion carried.

 

 

Motion by James C. Marker, seconded by John P. Vatavuk to approve the Agreement between the County of Somerset and SOUTHWESTERN PA LEGAL SERVICES, INC. of 10 West Cherry Lane, Washington, PA  15301, to provide legal services in the amount of $50.00 per hour.

 

The vote was unanimous.  Motion carried.

 

 

Motion by James C. Marker, seconded by John P. Vatavuk to approve the Agreement between the County of Somerset and JANE ZEIGLER of 1621 Outer Drive, Somerset, PA  15501, to provide registered dietician services in the amount of $25.00 per hour.

 

The vote was unanimous.  Motion carried.

 

 

Motion by James C. Marker, seconded by John P. Vatavuk to approve the Agreement between the County of Somerset and TWIN LAKES CENTER, INC. of 224 Twin Lake Road, Somerset, PA  15501, to provide protective service and on-call support in an amount not to exceed $1,000.00 per contract year.

 

The vote was unanimous.  Motion carried.

 

 

Motion by James C. Marker, seconded by John P. Vatavuk to approve the Agreement between the County of Somerset and ATTORNEY GORDON REYNOLDS of 204 West Main Street, Suite 202, Somerset, PA  15501, to provide Administrative Legal Services in the amount of $50.00 per hour.

 

The vote was unanimous.  Motion carried.

 

 

Motion by James C. Marker, seconded by John P. Vatavuk to approve the Agreement between the County of Somerset and MEADOW VIEW NURSING CENTER of 1404 Hay Street, Berlin, PA  15530, to provide emergency shelter in the amount of $138.00 for a semi-private room and $148.00 for private room.

 

The vote was unanimous.  Motion carried.

 

 

Motion by James C. Marker, seconded by John P. Vatavuk to approve the Agreement between the County of Somerset and CLUB FITNESS CENTER of 105 East First Street, Somerset, PA  15501, for water walking exercise classes in the amount of $1.00 per participant, per class, per day.

 

The vote was unanimous.  Motion carried.

 

 

Motion by James C. Marker, seconded by John P. Vatavuk to approve the Agreement between the County of Somerset and MEMORIAL MEDICAL CENTER SCHOOL OF NURSING of 1086 Franklin Street, Johnstown, PA  15905, to provide, at no cost, education programs and clinical experience for seniors participating at Somerset Senior Center by student nursing interns.

 

The vote was unanimous.  Motion carried.

 

 

Motion by James C. Marker, seconded by John P. Vatavuk to approve the Data Services Agreement with attached Business Associate Letter Agreement between the County of Somerset and the Area Agency on Aging (AAA) for the Somerset County Data Processing Department (SCDPD) to provide support services to AAA in the installation, maintenance and repair of AAA’s computer and communications equipment, software and records, in the amount of $27.00 per hour not to exceed $10,000.00.

 

The vote was unanimous.  Motion carried.

 

 

Motion by James C. Marker, seconded by John P. Vatavuk to approve the Human Resources Agreement with attached Business Associate Letter of Agreement between the County of Somerset and the Area Agency on Aging (AAA) for the Somerset County Human Resource Department (SCHRD) to provide support services to AAA in Human Resource Activity, in an amount not to exceed $19,250.00.

 

The vote was unanimous.  Motion carried.

 

 

 

Children and Youth Services

 

Motion by James C. Marker, seconded by John P. Vatavuk to ratify the advertisement for bids for two new vehicles for Children and Youth Services; bids are due in the Commissioners’ Office on or before Monday, June 23, 2008 at 10:00 a.m.

 

The vote was unanimous.  Motion carried.

 

 

 

Tableland Services, Inc.

 

Motion by James C. Marker, seconded by John P. Vatavuk to approve the Consulting Agreement between the County of Somerset and PATRICIA B. SCHWARTZ & ASSOCIATES of 60 Gordon Road, Fairfield, PA  17320, for training and consultation in fund raising and resource development in the amount of $3,000.00 plus reimbursable expenses.

 

The vote was unanimous.  Motion carried.

 

 

 

Register of Wills’ Office

 

Motion by James C. Marker, seconded by John P. Vatavuk to approve the request of Sharon Ackerman, Register of Wills for KAYLA MENEAR of Rockwood, Pennsylvania, to complete an unpaid summer internship in the Register of Wills’ Office.

 

The vote was unanimous.  Motion carried.

 

 

 

Bedford-Somerset MH/MR Program

 

Motion by James C. Marker, seconded by John P. Vatavuk to ratify the advertisement for bids for seventeen new vehicles for the Bedford-Somerset MH/MR Program and Behavioral Health Services of Somerset and Bedford County; bids are due in the Commissioners’ Office on or before Friday, June 20, 2008 at 10:00 a.m.

 

The vote was unanimous.  Motion carried.

 

 

 

Probation Department

 

Sean Dolan, Probation Officer stated that the Probation Department’s Community Service Recycling Grant Program funds in the amount of $2,020.00 were awarded to six non-profit organizations by the Commissioners at the last meeting.  He explained that the Community Service Crews work sorting the recycling that is collected in recycling bins located at the Somerset Wal-Mart, Rockwood and Turkeyfoot School Districts.  Funds received from this program are then awarded to complete community service improvement projects throughout the County.  Mr. Dolan stated that the Community Service Crews also help to complete the community improvement projects. Amanda Deal of the Conservation District and Matt Grohal of the Windber Recreation Association were present for a picture and explained a little about each of their organizations’ projects.

 

 

Motion by James C. Marker, seconded by John P. Vatavuk to accept the resignation of REBECCA WITT of Somerset, Pennsylvania from her position as Probation Officer I for the Probation Department, effective June 27, 2008.

 

The vote was unanimous.  Motion carried.

 

 

 

Sheriff’s Department

 

Motion by James C. Marker, seconded John P. Vatavuk to accept the resignation of DEBORAH BERKEY of Johnstown, Pennsylvania from her position as Clerk in the Sheriff’s Department, effective May 23, 2008.

 

The vote was unanimous.  Motion carried.

 

 

Motion by James C. Marker, seconded by John P. Vatavuk to approve the request of John Mankey, Sheriff, to hire JANIE GNAGEY of Meyersdale, Pennsylvania, as Clerk in the Sheriff s Department at an annual salary of $15,392.00, effective June 11, 2008.

 

The vote was unanimous.  Motion carried.

 

 

 

Child Custody & Visitation Office

 

Motion by James C. Marker, seconded by John P. Vatavuk to approve the unpaid leave of absence for Employee #788 of the Child Custody & Visitation Office beginning June 9, 2008.

 

The vote was unanimous.  Motion carried.

 

 

 

Assessment Office

 

Daniel W. Rullo, Solicitor explained that roll-back taxes were assessed to Marjory Barnick for property located in Jenner Township, due to a violation of the Pennsylvania Farmland and Forest Land Assessment Act or Clean and Green Program.  The violation was as a result of a subdivision of 8.242 acres of property to David B. Jr. and Priscillia F. Schmidt which is less than the minimum requirement of 10 acres.  An additional 1.758 acres has been transferred to David B. Jr. and Priscilla F. Schmidt to fulfill the acreage requirement.

 

 

Motion by James C. Marker, seconded by John P. Vatavuak to approve the waiver of the County’s share of roll-back taxes in the amount of $1,871.59 plus accrued interest assessed to Marjory Barnick for property located in Jenner Township, Parcel ID# 21-0-000870, as the violation has been cured.

 

The vote was unanimous.  Motion carried.

 

 

 

Great Allegheny Passage

 

Motion by James C. Marker, seconded by John P. Vatavuk to approve the Proposal between the County of Somerset and SOMERSET PLANNING & ENGINEERING SERVICES, LLC, of 222 West Main Street, Suite 100, Somerset, PA  15501, to prepare a base map of the Somerset County trail system utilizing geo-referenced color orthophotographs and a plot of available railroad valuation mapping; establish a system of survey control, utilizing global positioning methods, across the trail system; and perform detailed property boundary surveys in areas of concern identified by county personnel in the amount of $18,600. 

 

The vote was unanimous.  Motion carried.
