TUESDAY:  A Regular Meeting of the Somerset County Board of Commissioners was held at 11:02 a.m. in the Commissioners’ Board Room.

 

 

PRESENT:  Pamela A. Tokar-Ickes, John P. Vatavuk, and James C. Marker, Commissioners; Mike Faher, Tribune-Democrat; William Vescio, Bryan Funding, Inc.; Mike Zubasic, PNC Capital Markets; Jay Wenger, Susquehanna Group Advisors; Chris Brewer, Dinsmore & Shohl, LLP; Randy Welker, Fiscal Analyst; Vince Pavic, Human Resources Director;  Shari Ziegler, Office Coordinator; and Sonya Augustine, Assistant Chief Clerk.

 

 

 

Approve Minutes

 

Motion by James C. Marker, seconded by John P. Vatavuk to approve the minutes of the regular meeting held on July 21, 2009.

 

The vote was unanimous.  Motion carried.

 

 

 

Approve Payment of Bills

 

Motion by James C. Marker, seconded by John P. Vatavuk to approve the payment of bills in the amount of $865,715.67.

 

The vote was unanimous.  Motion carried.

 

 

 

Travel Requests

 

Motion by James C. Marker, seconded by John P. Vatavuk to approve the following travel requests:

 

request for Tina Pritts, Director of Elections, to attend the Annual Election Conference on August 17-20, 2009 in Pocono, Pennsylvania; and

 

request for Karen Ritchey of the Area Agency on Aging to attend the Quality Council Meeting on August 3, 2009 in Harrisburg, Pennsylvania.

 

The vote was unanimous.  Motion carried.

 

 

 

Children & Youth Services

 

Motion by James C. Marker, seconded by John P. Vatavuk to approve the request of Charles Crimone, Administrator of Children and Youth Services, to hire LAURIE DEIST of Hollsopple, Pennsylvania as a Full-Time Caseworker III for Children and Youth Services at an annual salary of $23,231.00, effective August 5, 2009.

 

The vote was unanimous.  Motion carried.

Motion by James C. Marker, seconded by John P. Vatavuk to approve the following Offer to Purchase Property at Private Sale, subject to approval of the municipality and school district involved as well as any objection to the Courts:

Motion by James C. Marker, seconded by John P. Vatavuk to approve the exoneration of County real estate taxes, interest, and costs owed on a dilapidated trailer located in Jennerstown Borough, Reference #22-0-004950 in the amount of $255.30, subject to the exoneration of taxes by the North Star School District; similar action has been taken by Jennerstown Borough. 

 

The vote was unanimous.  Motion carried.

 

 

 

Information Technology Department

 

Motion by James C. Marker, seconded by John P. Vatavuk to approve the request of Glen Wagner, Information Technology Director, to appoint EVAN SHANNON of Stoystown, Pennsylvania to a paid internship in the Information Technology Department, at an hourly rate of $7.80, beginning on August 3, 2009, not to exceed 32 hours per week.

 

The vote was unanimous.  Motion carried.

 

 

 

Courts

 

Motion by James C. Marker, seconded by John P. Vatavuk to acknowledge the appointment by Judge John M. Cascio of EMILY BRISTOL of Somerset, Pennsylvania, effective August 17, 2009; and MATTHEW WENDLER of Pittsburgh, Pennsylvania, effective August 17, 2009, as Judicial Law Clerks at annual salaries of $35,000.00.

 

The vote was unanimous.  Motion carried.

 

 

 

Probation Services

 

Motion by James C. Marker, seconded by John P. Vatavuk to approve the unpaid leave of absence for Employee #1238 of the Probation Department for July 2, 6, and 7, 2009.

 

The vote was unanimous.  Motion carried.

 

 

 

Somerset County Jail

 

Motion by James C. Marker, seconded by John P. Vatavuk to approve the request of Thomas Perrin, Warden of the Somerset County Jail, to transfer CHAD SNYDER of Boswell, Pennsylvania from his position as Full-time Sheriff’s Deputy to Full-Time Lieutenant for the Somerset County Jail at an annual salary of $32,000.00, effective August 17, 2009.

 

The vote was unanimous.  Motion carried.

 

 

 

Area Agency on Aging

 

Motion by James C. Marker seconded by John P. Vatavuk to approve the request of Arthur DiLoreto, Administrator of the Area Agency on Aging, to appoint SHARON CUSTER of Central City, Pennsylvania as a Clerk Typist II for the Area Agency on Aging at an annual salary of $14,430.00, effective August 5, 2009.

 

The vote was unanimous.  Motion carried.

 

 

 

Variable Rate Demand Bonds, Series 2008A and 2008C

 

Christopher Brewer of Dinsmore & Shohl, LLP, Jay Wenger of Susquehanna Group Advisors, and Mike Zubasic of PNC Capital Markets presented an ordinance for adoption to authorize the incurrence of non-electoral indebtedness in connection with refunding of the Variable Rate Demand Bonds, Series 2008A and Variable Rate Demand Bonds, Series 2008C.    This recommendation is made to eliminate risk and refinance at a lower interest rate.

 

 

Motion by James C. Marker, seconded by John P. Vatavuk to adopt Ordinance No. 1 of 2009 summarized as follows:

 

AUTHORIZING THE INCURRING OF NONELECTRICAL INDEBTEDNESS IN AN AGGREGATE PRINCIPAL AMOUNT NOT TO EXCEED TWENTY MILLION AND ONE HUNDRED TWENTY THOUSAND DOLLARS ($20,120,000) BY THE EXECUTION AND DELIVERY OF A BOND INDENTURE BY AND FROM THE COUNTY OF SOMERSET, TO WELLS FARGO BANK, N.A., AS TRUSTEE; CONVENANTING TO PAY, AND PLEDGING UNLIMITED TAXING POWER FOR THE PAYMENT OF, THE BOND UNDER THE BOND INDENTURE; AUTHORIZING FILINGS OF REQUIRED DOCUMENTS WITH THE DEPARTMENT OF COMMUNITY AND ECONOMIC DEVELOPMENT; DIRECTING ACTIONS OF OFFICERS AND OTHER ACTIONS; AND MAKING OTHER CONVENANTS IN RESPECT OF THE BOND INDENTURE.

 

which Ordinance is set forth at length in the Ordinance Book.

Motion by Donna Schmitt, seconded by James C. Marker to approve the Request for Vesting submitted by CONSTANCE BEACHY of Fort Hill, Pennsylvania, whose last day of work as RSVP Information and Data Manager for the Area Agency on Aging was June 30, 2009.

 

The vote was unanimous.  Motion carried.

 

 

 

William Vescio of Bryan Funding, Inc., presented the report on the Somerset County Employees’ Retirement Fund for the Second Quarter of 2009, a copy of which is attached hereto.
